Zoning and Land Use

Our firm has a long track record of rezoning success.  No matter how controversial the matter, our firm will not waiver or back down when representing our clients.  We have developed professional relationships with local Zoning Administrators, City Councils, and County Commissioners which allow us to effectively present the client’s rezoning or variance application with the greatest chance of success.  If there is a controversial zoning, our firm is normally involved, and despite heavy opposition, we have a record of success.  Over the years we have represented residential, commercial, and industrial developers, as well as businesses and property owners throughout Northwest Georgia.  We have successfully rezoned multi-million dollar manufacturing facilities, large commercial and industrial parks, and multi-family developments.  Some of these successes include:  the rezoning of a residential tract to Heavy Industrial resulting in construction of a multi-million dollar industrial facility, increased taxes for Bartow County and hiring of hundreds of employees; the rezoning of a residential tract to General Commercial for a national pharmacy chain; the rezoning of a commercial tract to Heavy Industrial resulting in the relocation of a national manufacturer in Bartow County; the rezoning of an agriculture tract to a Planned Unit Development for a major real estate developer resulting in the development of a live-work-play community; and the rezoning of a large residential and agricultural tract for a major industrial park.     Some of our clients in this practice area include Americo, Anverse, Bartow-Cartersville Joint Development Authority, Dellinger Management, Lynwood Development Group, Pilgrim’s Pride, Southern Media Group, Tilley Properties, and Toyo Tire.  Our experience in this area of the law allows us to provide the following services:

* Preparation of rezoning and variance applications and representation throughout the hearing process

* Representation of clients before the Planning Commission, City Council, County Commissioner, and Board of Zoning Appeals

* Amendments to Zoning Ordinances

* Consultation regarding land use, and the zoning process
